Understanding Federal Sexual Harassment Laws
Legally, sexual harassment is considered a type of sex or gender discrimination. Specifically, the Equal Employment Opportunity Commission (EEOC) defines it as "unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature."
Sexual harassment in the workplace is a violation of Title VII of the federal Civil Rights Act. There are two main types of workplace sexual harassment:
- Quid pro quo: If you have been told or led to believe that you will be fired, denied a job, demoted or denied a promotion unless you accept an employer's sexual advances, that is considered quid pro quo sexual harassment.
- Hostile work environment: If you have been subjected to verbal and physical conduct of a sexual nature that unreasonably interferes with your ability to do your job, that is considered hostile work environment sexual harassment.
